first, i would like to say thati dont have my codexs on me so i cant check but, i believe that in the old codex, next to where it says that a fusion blaster is assualt 1 melta, it says "does not overheat", but the new one says neither if it does or doesnt over heat. so, my question is, 1. if using the new codex, does it overheat and 2. if so, can i decide to use the old codex instead of the new one?

It does not have the Gets Hot! rule or anything relating to overheating, & neither do Melta or Assault weapons in general, therefore, it does not overheat. As to 2., I don't think you can use an outdated Codex.

It doesn't. If it were to overheat, it would indicate 'Get hot' in the last column.
And no, you cannot use an old codex just because the rules is more advantageous. The only time the use of an older codex is allowed is if there is no more recent edition (such as Dark Eldar and Necron) or you are playing with that edition rules. So 3rd ed Tau codex in a 3rd ed WH40K Game. Granted your opponent may be leniant and allows it, but must would demand you play with the more recent rules. And as a rules the new codex overrides the old.

i allow people to use older codexs if they use that codex or for a special character or unit that wasn't included in the new one (aun'shi, leman russ exterminator for example) thats if we're doin friendly games... every now n again we do our own mini tournies then we do everything correctly tho.

Yes for special characters, or vehicules/unit that didn't make the crossover I have no problem with thme either in friendly games (although I would be using the most recent edition for wargear description though).
But in the exemple presented by fiercegoldfish, I would not allow the use of an older edition just because it's more advantageous then the most recent one...granted it turned out that his exemple the rule was carried over but indicated differently so there would be no issue there.
