A unit can retreat out of assult if it has the hit and run rule otherwise it cannot. Yet it has to test to see if you run in assult. You cant chose not to really. There is no penalty for hit and run units other than they can be shot at afterwords but so Can the unit that was in assult. but the hit and run unit can charge again on your turn.

No.

You are also not allowed to retreat from a HTH combat you cannot win, such as with a wraithlord or dread that your troops cannot actually hurt.
You just have to hope you fail the leadership test.

Stupid, but true.

Don't tell me that you fell for the MTV lie?
The MTV lie is that people who rebel against tradition are thnking for themselves, while those who follow tradition are just sheep who do not think.
It is, of course, completely untrue. The decision to follow tradition is just as much an exercize of free will as is the decision to depart from it.

It's rumoured that in the new Codex, Space Marines will be able to voluntarily fail such tests, presumably as part of And They Shall Know No Fear, but that's it. No-one else (or not very many of them) can do that. For most armies in most cases it's a bad idea anyway since you won't necessarily regroup next turn, and even if you do you count as having already moved, but lucky ol' Space Marines are 100% guaranteed to turn around and blast the assaulter with Heavy Bolters and Missile Launchers on their turn. > Bye-bye Wraithlord. >
Although if you win the assault, you're still screwed. :-\
