Default Quick Question about independant character rules

We had a situation last night where a marshal was attached to a squad but wiped out all the guys around him. The next movement phase should he be able to break off from the unit and go solo even though they are still locked in assault but the marshal was not? The rules are not clear on it in my opinion and specifies what happens if the unit he is attached to is pinned or falling back. When it comes to breaking off it just says it has to be done in the movement phase, after assaults start its too late....there are 2 ways to read this imo.

At the end of the assault phase the two squads would have to consolidate into one another. The marshal, being currently a member of the squad, would have to make a move in an attempt to get into base contact with an enemy model.

Correct, the marshall is still apart of the unit that was in close combat. He is still stuck in close combat.

As has been stated he is still in the combat.

It clearly says that you may not detatch an IC from a unit when you are in cc. At least I believe it does... I'll look it up when I get home, I'm at school right now.

I think it is pretty clear. He is still "locked" in the close combat. This means that he can not move in the movement phase. And because he can't move, he can't leave coherency in order to count as leaving the unit he was attached to.

He could leave in the following movement phase if, and only if, the squads were unable to get into contact with each other in the consolidate.

During the consolidation the IC didn't get engaged in base to base and was a good inch from every model int he assault is one of the reasons this popped up. The squad was in base to base with the opposing unit. Being that IC's operate sorta independently (with regards to who can attack them and whom they can attack) in an assault this came up.

Even if he can not reach the enemy as long as the unit he is joined with is in CC he is stuck in CC. Your only option if you want to extract him is to let all your people in base contact die (assuming the enemy kills that many) so that you can end the combat long enough for him to leave on his next movement phase.

Well, if the squad is in base...he's stuck.

Now, if you have a number of squads in combat, you can, through careful ordering of which squads pile in first, ensure there's no way for the squad with the special char to get in...it's the only time this really tends to come up. If you are going to get that unit into combat though, do try to get the IC in base, as otherwise, he sorta just sits there.
