Considering he could have paid the bank the money, yet they refused it i think he is right.

As to the legality of the bank refusing his money but deciding to take his home for more? is that right?

Nice story, but I smell a rat. Something about this guy seems a little off. I can't help but wonder if there isn't more to the story than he's letting on.

I agree that I would like a bit more info on this as you can't help but feel there is a catch.

However based on what has been said in the article I cannot fault him. He got an offer that would have cleared his debt and left him with one property. The bank refused and wanted both still though they could probably get twice what he owed from one. I cannot help but think this is an attempt to use foreclosure to take advantage of a man when he was down.

Nice.

In Australia we have legislation to protect consumers from opportunistic seizures of collateral by lenders. If this had happened in Australia the lender would only ever have been entitled to the amount outstanding on the loan. It is just simply a better system as it creates market conditions that are conductive to the health of the housing market as a whole.

But why would anyone care about economic stability, when you can make a short term profit bonanza?

Awesome. Bank tries to be a dick, guy gives bank the finger in a dramatic fashion. Even if he ends up in jail for it, I salute this man.
