Note: I'm from Austria

A friend of mine who is a journalist regularly browses english-speaking newssites. He stumbled upon this article about Obama's trip to Europe in the Washington Post:

And what did he get for Guantanamo? France, pop. 64 million, will take one prisoner. One! (Sadly, he’ll have to leave his bridge partner behind.) The Austrians said they would take none. As Interior Minister Maria Fekter explained with impeccable Germanic logic, if they’re not dangerous, why not just keep them in America?

When Austria is mocking you, you’re having a bad week.
Fair enough. But the real gem was the accompanying comment of a user (if it was ironic or not, I have no idea).

Also, to further prove that Europe has it in for our Southern neighbors, Spain is charging six top Bush staff with torture.

Not sure if it extends to members of an administration, but if any US Soldier is ever brought before a foreign or international court the United States must retaliate against the state or states harboring the court.

Not entirely applicable here. Several things apply:

1 ) The law you're referring to only exempts soldiers from trial while they were actively executing their orders. Remember that Marine who raped the girl in Okinawa a few years ago? I'm pretty sure he was handed over.

2 ) Members of an administration are not military personnel. That's why Blackwater could technically be prosecuted. It also means that the President would be exempt (CnC). I believe that ambassadors also enjoy diplomatic immunity but do not fall under the military exemption.

That said, it's not often that the US complies with extraditions of US citizens. However, if Spain agreed to take a few gitmo detainees... :shifty:

Fat chance of that! The EU fell all over itself to talk smack about Gitmo and how the poor detainees were innocents wrongly imprisoned. But now that it actually comes down to putting their money where their mouth is none of them will take any of these innocent prisoners because they are a security risk. What a load!

Anyways, Obama would never turn former administration officials over because it would be political suicide in the USA.
