Default GW Gallery Image Removal

Due to increasing number of GW copyrighted images cropping up in the Tau Online Gallery, we will be deleting such images shortly (rather then wait to be prompted to do so by GW themselves).

We will only be removing images that are copyrighted by Games Workshop (like army icons for the Salamanders etc).

So if your image(s) disappear over the next day or so, you have an idea why.

Just so that no one thinks we're doing this for the lulz...

WHAT YOU CANNOT DO WITH GAMES WORKSHOP'S INTELLECTUAL PROPERTY (...) - Make any direct copies and/or scans of Games Workshop publications, images, or other materials. This includes any Out-o- Production materials, web site materials, and White Dwarf articles. We would however suggest that you produce your own materials (as long as you follow the other requirements of this policy).

If you have drawn or painted or whatever your own version of anything GW owns, it's legit. Direct copy + paste from a GW publication (including their entire website) is a breach of their copyright.

So, does this mean we just link to the GW website instead of copy-pasting the images? (I'm mainly thinking of the news and rumours section here as some people do that rather than linking to the page)

That would probably be for the better.

The vast majority of the time, absolutely you should just link to the article if possible. Unfortunately...

Bandwidth Theft and Mirroring Resources

We do not tolerate deep linking to the pictures, images, PDFs or other downloads on our website. Such activity is bandwidth theft. Also, do not mirror the resources that we have on our websites. So, if you want other people to see the materials that we have produced, please use a simple HTML link to the relevant web page.

The biggest problem they've had is with people using their materials on eBay and the like. Using someone else's copyright to sell stuff is a definite no-no. However, their copyright is broad enough that you have to be careful of what you copy+paste (for example: you cannot replicate the statlines on their website). Keep on reading, however, to learn a little bit more.

Just as an example...

http://www.chillingeffects.org/copyr...NoticeID=30508

It has come to our attention that artwork from the Warhammer 40,000 intellectual property has been used on the website www.librarium-online.com which we believe you administrate. Enclosed with this letter is an example of a page from the Librarium Online website showing the use of images from the Warhammer 40,000 Space Wolves codex book and packaging. As this use of Games Workshop's copyright is unauthorised, it is considered by Games Workshop to be an infringement of its intellectual property rights.

General copyright reading: http://www.templetons.com/brad/copymyths.html

Fair Use: http://w2.eff.org/IP/eff_fair_use_faq.php

Note here regarding fair use:

Courts have previously found that a use was fair where the use of the copyrighted work was socially beneficial. In particular, U.S. courts have recognized the following fair uses: criticism, comment, news reporting, teaching, scholarship, research and parodies.

And that right there is the saving grace for the news & rumours board. You're allowed to copy materials there because the board itself is used to critique, comment, and report on news regarding GW... just don't be stupid about it.

So, overall: news & rumours is unaffected, just remember to attribute everything 100%. Anything else is a no-go.
